(MUNICIPALITY MARKSTAY-WARREN, ON) - On June 28, 2018 at approximately 3:10 p.m. members of the Ontario Provincial Police (OPP) Sudbury Detachment were patrolling Highway 535 in the Municipality of Markstay-Warren, Ontario when they observed the driver of a pick-up truck using a handheld entertainment device.
A traffic stop was conducted. While speaking with the driver, officers observed that he was under the influence of alcohol. The driver refused to provide police with a breath sample.
Alain CHEVRIER, 36 years of age, of St-Charles, Ontario was arrested and charged with:
Fail or Refuse to Provide Sample contrary to section 254(5) of the Criminal Code of Canada (CC)
Drive Motor Vehicle on a Highway while Holding/Using a Hand-held Electronic Entertainment Device contrary to section 78.1(2) of the Highway Traffic Act (HTA)
The accused was issued a 90 day Automatic Drivers Licence Suspension (ADLS), and the vehicle was impounded for seven days. He was released on an Appearance Notice and is scheduled to appear at the Ontario Court of Justice in Sudbury, Ontario, on August 15, 2018.
