(CARLING TOWNSHIP, ON) - On July 7, 2018 shortly after 9 p.m., a member of the West Parry Sound Detachment of the Ontario Provincial Police (OPP) responded to a report of a possible impaired driver on Snug Harbour Road in Carling Township, Ontario.
Police located the vehicle on Highway 559 and observed the vehicle weaving on the roadway and crossing the lines. Police stopped the vehicle and the officer spoke to the driver determining that he had consumed alcohol.
As a result of the investigation Troy BUXTON, a 26 year old male from Carlisle, Ontario was arrested and charged with:
Drive motor vehicle - over 80 mgs. of blood alcohol, contrary to section 253(1)(b) of the Criminal Code,
Drive motor vehicle while ability impaired - alcohol, contrary to section 253(1)(a) the CC,
Drive motor vehicle no validated plate contrary to section 7(1)(c)(i) of the Highway Traffic Act (HTA),
Drive motor vehicle not equipped with an approved ignition interlock device contrary to section 41.2(13) of the HTA,
Operate vehicle without insurance contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act (CAIA), and
Drive motor vehicle with open liquor contrary to section 32(1) of the Liquor Licence Act (LLA).
The driver was released on a Promise to Appear and is scheduled to appear at the Ontario Court of Justice in Parry Sound, Ontario on July 19, 2018.
The passenger, Wesley GOURLEY, a 23 year old male from Flamborough Township was charged and issued Provincial Offence Notices with:
Being intoxicated in public, contrary to section 31(4) of the LLA, and
Having liquor in open container in other than licence premises, contrary to section 31(2) of the LL.
The OPP reminds motorists that there is no safe amount of drug or alcohol consumption when driving. Anyone who suspects a driver that is driving while impaired is urged to call police by dialing 9-1-1 immediately.
